General terms and conditions of sale Monaco Red Sails
Article 1 – Scope of application
The present General Conditions of Sale (called “GCS”) apply, without restriction or reserve, to all sales concluded by the Seller (MONACO RED SAILS) with non-professional Buyers (“The Customers” or “The Customer”), wishing to acquire products or services offered for sale by the Seller on the Site www.monacoredsails.com
The products/services offered for sale on the Site are the following
– Sea outings
– Boat privatization
All the details and characteristics of the products/services are presented on the Site www.monacoredsails.com , the Customer being required to take note of them before placing his order on line. The choice and purchase of a product/service are the sole responsibility of the Customer.
The images used on the entire website www.monacoredsails.com are the most faithful possible but cannot ensure a perfect similarity with the products and services offered.
These GTC are accessible at any time on the website www.monacoredsails.com and will prevail over any other document.
The Customer declares that he/she has read these GTC and has accepted them by checking the box provided for this purpose before the implementation of the online ordering procedure on the Site www.monacoredsails.com .
Unless proven otherwise, the data recorded in the Seller’s computer system shall constitute proof of all transactions concluded with the Customer.

Article 2 – Prices
The products and services offered are provided at the prices in force on the Site www.monacoredsails.com , at the time of the recording of the order by the Salesman. The prices are expressed in euros including all taxes.
These prices are firm and non revisable during their period of validity but the Seller reserves the right to modify the prices at any time according to the economic situation (surcharge, fuel…) or modification of the taxes (VAT, TPM, port and usage taxes). However, the products and services will be invoiced to the Customer on the basis of the rates in force at the time of validation of the order.
The payment requested from the Customer corresponds to the total amount of the purchase.
Article 3 – Reservations/Online orders
It is up to the Customer to select on the site www.monacoredsails.com the products and services he wishes to order, according to the following modalities:
The Customer places his order on line on the Site www.monacoredsails.com . All contractual information is presented in English.
The Customer declares to have taken knowledge of the CGV before the placing of his order and recognizes that the validation of his order implies the acceptance of their terms.
In order to place an order, the Customer must provide the Seller with personal data and fill in an online form accessible from the Site www.monacoredsails.com .
The sales contract between the Vendor and the Customer is formed when the Customer clicks on the “I have read and accept the General Terms and Conditions of Sale” checkbox when confirming his/her Order.
Until this final step, the Customer will have the possibility to go back to the previous pages and correct or modify his order and the information previously provided.
A confirmation e-mail, acknowledging receipt of the order and containing all the information contained therein, will then be sent to the Customer as soon as possible. The Customer must therefore provide a valid e-mail address when filling in the fields relating to his/her identity.
In the event that a product or service ordered by the Customer is unavailable, the Vendor undertakes to inform the Customer by e-mail or by telephone as soon as it becomes aware of such unavailability.
The offers of products and services are valid as long as they are visible on the site, within the limits of available stocks.
The sale will be considered valid only after full payment of the price. It is the customer’s responsibility to verify the accuracy of the order and to correct or report any errors immediately.
Any order placed on the Site www.monacoredsails.com constitutes the formation of a contract concluded at a distance between the Customer and the Seller.
The Vendor reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
Article 4 – Terms of payment
The price is paid by secure payment, according to the following methods:
– Payment by credit card
The price is payable in full by the Customer on the day of the online order.
The payment data are exchanged in encrypted mode thanks to the protocol defined by the approved payment service provider involved in the banking transactions carried out on the site www.monacoredsails.com .
The payments made by the Customer will be considered final only after effective collection by the Seller of the sums due.
Article 5 – Reservation of the order
The confirmation of the order will be made directly by email.
The confirmation email will be delivered to the address indicated by the Customer in the form filled in during the online order; a lack of email address will not engage the responsibility of the company MONACO RED SAILS.
Article 6 – Conditions of use – Regulations
The shipping company MONACO RED SAILS reserves the right to unexpectedly modify the days and times of the sea trips, the duration of the services or their itinerary (weather conditions, technical problem, maintenance, insufficient attendance…).
In case of delay of a passenger, whatever the reason, the crew reserves the right to leave without the latecomers. The latter will not be reimbursed nor will they have access to another exit with the following reason.
Passengers must keep their confirmation email in order to be able to present it at any control. In any case, they agree to abide by the rules established by the captain and his crew on board the ships.
MONACO RED SAILS authorizes its clients to bring food and drink on board the catamarans during the sea trips.
MONACO RED SAILS reserves the right to modify/vary the meals served on board depending on the supply.
People with reduced mobility are welcome on board, but we do not have standard access on all boats. Please inform us in advance when making your reservation.
Pregnant women and babies are welcome on board, unless otherwise advised by a doctor. Minors must be accompanied by an adult. Children are under the full responsibility of their parents.
Pets are not allowed on board.
In general, shoes are not allowed on board.
MONACO RED SAILS is not responsible for cash, jewelry and other objects carried by passengers, for their theft, loss or deterioration due for example to the natural movements of the boat, to the state of the sea or otherwise.
Bicycles are not allowed on board. Strollers may be taken on board.
Article 7 – Cancellation conditions – Refunds
Reservations are valid for a specific date.
Orders are non-refundable. In case of cancellation by the Customer, whatever the reason, no refund will be allowed. However, in case of cancellation of a sea trip by MONACO RED SAILS (weather conditions, technical problems, insufficient attendance or others), the trip will either be postponed to another date or reimbursed in full to the customer.
MONACO RED SAILS grants the customer the possibility to postpone his cruise to a later date but within the current season and within the limit of available places and cruises. However, the Client cannot exchange his sea trip for another service. Rescheduling is only possible if the Client informs the provider by phone or email at least 72 hours before the cruise for which he/she purchased the ticket. No reservation can be modified less than 72 hours before boarding.
In case of no-show at boarding or in case of delay, the tickets will not be refunded.
In case of insufficient numbers, the MONACO RED SAILS company reserves the right to cancel at any time an outing or to postpone it to another date. The Customer will be offered either a new date for the sea trip or a full refund.
Article 8 – Boarding
The Customer is informed that the boarding of the passengers is done 15 minutes before the departure time of the ship.
In case of no-show at boarding or in case of delay, whatever the reason, the order will not be refunded.
Article 9 – Responsibility
All passengers on board MONACO RED SAILS boats must abide by the established rules and regulations as well as the instructions of the captain and his crew. MONACO RED SAILS cannot be held responsible for the non-respect of the safety instructions by the customers.
MONACO RED SAILS cannot be held responsible for any damage, loss or theft of objects belonging to the passengers, due to the natural movements of the boat, weather conditions or other.
MONACO RED SAILS cannot be held responsible for any delay or cancellation due to weather conditions.
Article 10 – COVID-19 measures
The buyer or the customer commits himself to take knowledge and accept the sanitary measures set up to fight against the propagation of COVID-19 in our ticket offices, on the embarkation docks and on board the ship.
– Mandatory wearing of a mask on board from 11 years old when the rules of physical distancing cannot be guaranteed
– Hydro-alcoholic gel is available on board
– The catamarans are completely disinfected every day at each rotation
– Respect of social distancing on board
– Any passenger showing symptoms of infection related to COVID-19 before boarding, should not come on board and on the boarding platform. The passenger must contact MONACO RED SAILS by phone to inform them of their absence from the boarding gate. For any request for reimbursement, the passenger must provide a medical certificate from a doctor attesting to his or her covid-19 symptoms. Otherwise, the refund cannot be made.
– In the event of a rebooking, we will refund the full amount without any fees.
Article 11 – Personal data
The Customer is informed that the collection of his personal data is necessary for the sale of the products/services and their delivery. These personal data are collected only for the execution of the sales contract. See legal notice.
Article 12 – Intellectual property
The content of the site www.monacoredsails.com is the property of the Seller and is protected by Monegasque and international laws relating to intellectual property.
Any total or partial reproduction of this content is strictly forbidden and is likely to constitute an offence of counterfeiting.
Article 13 – Applicable law
These GTC and the operations resulting from them are governed by and subject to Monegasque law.
These GTC are written in English. In the event that they are translated into one or more foreign languages, only the English text will be deemed authentic in the event of a dispute.
